Terms of Use

1. Agreement

These Terms of Use ("Terms") are an agreement between you and Tayeb Sahebzada ("we", "us"), the publisher of the My Progress Buddy iPhone app ("the app"). By downloading or using the app you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the app.

The app is licensed to you through Apple's App Store. Apple's Licensed Application End User License Agreement ("Apple's EULA") also applies. If these Terms and Apple's EULA conflict, these Terms apply to the extent permitted, except for the provisions of Apple's EULA that Apple requires to prevail.

2. Who can use the app

You must be at least 13 years old, and if you are under the age of majority where you live, you need a parent or guardian's permission. You're responsible for complying with the laws that apply to you.

3. What the app is, and isn't

The app creates 3D scans of a person's body with an iPhone's camera and LiDAR sensor, and lets you view, compare and measure them over time.

• Not medical advice. The app is for general fitness and personal tracking. It is not a medical device and doesn't diagnose, treat or prevent any condition. Talk to a qualified professional before making health, diet or training decisions.
• Estimates, not exact figures. Sizes and measurements come from camera and depth data and can be affected by pose, clothing, lighting, movement and the device. They are best used to compare your own scans taken the same way. We don't guarantee their accuracy.
• Device requirements. Scanning needs an iPhone with a LiDAR sensor and a second person to hold the phone.

4. Consent and respectful use

Only scan yourself, or other people who have clearly agreed to be scanned. Don't scan anyone without their permission, secretly, or in a place where they expect privacy, and never scan minors without a parent or guardian's consent. Don't use the app or its scans to harass, shame or harm anyone, or in violation of any law.

5. Your content

The scans, models, measurements and other information you create in the app ("your content") belong to you. They are stored on your iPhone, not on our servers, so we can't recover them if they're lost. Keep your iPhone backed up if you want to keep them. Deleting the app deletes its data.

6. Free use and Premium

Free

Without a subscription you can keep up to 10 scans. You can always view, compare and measure the scans you have, even if you have more than 10 (for example after a subscription ends); adding new scans beyond 10 requires Premium.

Premium subscription

• Price and period: $4.99 USD per month (or the local price shown in the App Store), billed monthly.
• Free trial: eligible new subscribers get the first month free. If you don't cancel at least 24 hours before the trial ends, the subscription starts and you're charged.
• Payment: charged to your Apple ID when you confirm the purchase, or when the free trial ends.
• Automatic renewal: the subscription renews automatically each month unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the end of the current period.
• Managing and cancelling: in your iPhone's Settings → your name → Subscriptions, or in the app under Settings → Premium → Manage subscription. Cancelling stops future renewals; you keep Premium until the end of the period you've paid for.
• Refunds: purchases are handled by Apple, and refund requests go to Apple at reportaproblem.apple.com under Apple's policies. We can't issue refunds ourselves.
• Price changes: if the price changes, Apple will notify you in advance as required, and you can cancel before the new price applies.

7. Our app and content

The app, its design, code, name and logo belong to us and are protected by intellectual property laws. Apple's EULA grants you a personal, non-transferable license to use the app on Apple devices you own or control. Don't copy, modify, reverse engineer, resell or distribute the app except as the law allows.

8. Changes and availability

We may update, change or discontinue features of the app. We'll try to give notice of significant changes. If we ever stop offering Premium, active subscriptions won't renew.

9. Disclaimers

To the fullest extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We don't warrant that the app will be error-free or uninterrupted, or that scans or data won't be lost. Some places don't allow these exclusions, so some may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits, or decisions you make based on the app's measurements. Our total liability for any claim relating to the app is limited to the amount you paid us for the app in the 12 months before the claim, or US$50 if you paid nothing. Nothing in these Terms limits liability that can't be limited by law.

11. Ending use

You can stop using the app at any time by deleting it (and cancelling Premium in your Apple ID settings). We may suspend access to Premium features if you seriously violate these Terms. Sections that by their nature should survive (such as 5, 7, 9, 10 and 12) continue after you stop using the app.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law rules, except where the law of your country of residence gives you rights that can't be waived. Disputes will be resolved in the state or federal courts located in Virginia, unless the law where you live requires otherwise.

13. Changes to these Terms

We may update these Terms. We'll change the effective date above and, for significant changes, let you know in the app. Continuing to use the app after changes take effect means you accept them.

14. Apple

These Terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
